The Digital Millennium Copyright Act requires that all claims of infringement be in writing and contain the following information:

  1. a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. identification of the copyrighted work claimed to have been infringed;
  3. identification of the material that is claimed to be infringing;
  4. information to contact the complaining party (i.e., address, phone number, e-mail address);
  5. a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner or the law; and
  6. a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

When Monmouth University’s designated agent receives notice that a system user may be violating a copyright, the user will be issued a notice. The user is then required to remove the offending material or respond with a statement (under penalty of perjury) that the material is not infringing. System access may be disabled if the user does not respond.
